The Client also consents to OONA VENTURES SL using such information to contact them if necessary. If the information provided is insufficient, the order cannot be properly processed.
  • When necessary, provide a copy of valid proof of identity (National Identity Document, Passport, etc.) in order to comply with our obligations in relation to the prevention of money laundering, to ensure proper export of products when customs clearance is required, and to issue invoices correctly.
  • Not misuse this website by intentionally introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or materials.

AVAILABILITY OF SERVICE AND OUR PRODUCTS

The items offered by OONA VENTURES SL through this online store are available for worldwide shipping, except to countries affected by armed or political conflicts, or those subject to restrictions or legislation that may prevent the shipment of purchases. OONA VENTURES SL reserves the right to refuse purchases originating from such countries and to refund the buyers through the same method of payment used for their purchase.

All orders are subject to product availability. When a product is unavailable, it will be marked as “OUT OF STOCK.” In such cases, the client may contact us via the contact form available on the website or by email at info@oonacollections.com to enquire whether the product will become available again.

PRICES AND TAXES

The prices of all products on our website are shown in Euros and are those applicable at the time of purchase. The prices of all items displayed may be subject to change at any time; however, such changes shall not affect orders that have already been confirmed and for which confirmation has been sent to the client.

All prices for our products, as well as shipping costs and other services, include the applicable VAT rate in force at the time. Once all the items the client wishes to purchase have been selected, they will be added to the shopping basket in order to process the order and proceed with payment. Shipping costs will be added to each order at the time of purchase, and the final total price will be displayed before the transaction is completed and accepted.

For deliveries made to the Canary Islands, Ceuta and Melilla, the corresponding local taxes and duties shall apply in accordance with the legislation in force in each of these territories — IGIC or IPSI, respectively. Sales to these territories are considered exports; therefore, VAT will not be applied, and the client shall be responsible for paying the applicable taxes or import duties at customs (in accordance with the relevant local legislation).

For countries within the European Union, the rules governing intra-Community deliveries shall apply.

For sales to countries outside the European Union, the client shall be responsible for paying import duties and taxes upon arrival in the destination country (in accordance with the applicable local legislation).

INVOICING AND METHODS OF PAYMENT

By completing a purchase, the client authorises OONA VENTURES SL to issue the invoice in electronic format. Should the client wish to receive the invoice in paper format, they may request it at any time by contacting us through the contact form available on the website or by sending an email to info@oonacollections.com. In such cases, we will issue and send the invoice in the requested format to the address provided.

To make a purchase, the following methods of payment are available:

  • Debit or Credit Cards: Visa, Mastercard, or American Express. During the purchase process using this method, the client will be asked to provide the card’s identification number (CVV). The CVV is a 3- or 4-digit numeric value that provides encrypted verification of the information recorded on the card. This security feature is designed to protect the client against fraud. The CVV will not be stored in our systems, and the client must provide this number each time they make a purchase on our website. Credit card payments are subject to verification and authorisation by the issuing bank. If the bank does not authorise payment, we shall not be liable for any delay or failure to deliver, and we will not be able to formalise any contract with you. Should any unauthorised or fraudulent charge be made using the client’s card, the client must notify us as soon as possible so that the appropriate measures can be taken.
  • Direct Bank Transfer: If this option is selected, the Client must contact us by writing to info@oonacollections.com, and we will provide the necessary instructions to complete the transaction.

Only payments made in Euros (€) will be accepted. If you attempt to make payment using any other currency or method, we shall not be responsible for any loss of payment or any other damage caused by such action.

We use secure payment systems provided by leading financial institutions in order to guarantee the highest level of security. All transactions are processed through secure payment systems.

We are committed to always protecting our clients’ personal information, in accordance with our Data Protection Policy.

The order preparation process will only commence once the purchase request, client data, and chosen payment method have been verified.

ORDERS AND SHIPPING COSTS

Shipping is free for orders of €1000 or more within the EU and €1500 or more outside the EU.

To place an order, the client must follow the online purchase procedure. At the end of the purchase process, shipping costs (which will vary depending on the delivery destination) will be automatically calculated and included before payment, providing the client with the total final price.

If the client agrees with the final price, they shall proceed to select their preferred method of payment and complete the operation by clicking on “Authorise Payment.” Upon completion, the client will receive an email acknowledging receipt of the order (Order Confirmation). In addition, the client will be informed by email when the product has been dispatched (Shipping Confirmation) and will be provided with a tracking number.

OONA VENTURES SL reserves the right to cancel any confirmed order or to decline an order placed for the following reasons:

  • Lack of product availability, as described in the section AVAILABILITY OF SERVICE AND OUR PRODUCTS.
  • Orders originating from countries affected by armed or political conflict, or those subject to restrictions or legislation that prevent shipment, as described in the section AVAILABILITY OF SERVICE AND OUR PRODUCTS.
  • When there are indications suggesting that the client is underage.
  • When delivery cannot be made to the address provided by the client.
  • When the payment method provided by the client is incorrect or unverifiable.
  • When it is not possible to verify the customer's identity, or when there are reasonable indications of fraud, identity theft, or unauthorized use of the payment method used to place the order.

In such cases, OONA VENTURES SL will duly inform the Client in order to resolve the issue before taking any action, or will fully refund any amounts that may have been paid in respect of the cancelled purchase.

DELIVERY TIME FRAMES AND METHODS

All deliveries will be made through DHL Express to the address provided by the Client. Deliveries will not be made to P.O. boxes.

All our shipments are fully insured against loss, damage, and theft.

Orders and payment confirmations received after 3:00 p.m. local time will be processed on the next working day (business days are Monday to Friday, excluding public holidays as established in the official calendar).

For items in stock that are not personalised, custom-made, or made to order, OONA VENTURES SL offers the following delivery methods and timeframes:

  • Mainland Spain and Balearic Islands: Delivery within 5 to 7 full working days from the date of order placement and receipt of payment.
  • Canary Islands, Ceuta, and Melilla: Delivery within 12 to 15 full working days from the date of order placement and receipt of payment.
  • European Union: Delivery within 7 to 10 full working days from the date of order placement and receipt of payment.
  • Rest of the world: Delivery within 15 to 20 full working days from the date of order placement and receipt of payment.

For custom-made, made-to-order, or out-of-stock pieces, the production time will be approximately 6 to 8 weeks. Delivery times may vary accordingly.

For in-stock pieces that require any type of adjustment — such as resizing, chain length modification, etc. — the modification period will be approximately 15 days, subject to variation depending on the workshop’s workload.

Any shipment returned to the sender due to missing customs information, rejection, or incorrect address will have all shipping and related fees deducted from the amount to be refunded.

U.S. Customs may require U.S. customers to provide additional information, including their personal tax identification number.

In the event of unforeseen or extraordinary circumstances (such as strikes, severe weather conditions, or any other force majeure events), delivery times may be subject to variation.

During high-demand periods or promotional campaigns, delivery times may be affected and could be delayed beyond the estimated timeframes stated above.

For the purposes of these Terms of Use and Conditions of Purchase, delivery shall be deemed to have occurred at the moment the client, or a third party indicated by the client, physically takes possession of the product, as evidenced by signing the receipt of delivery at the agreed delivery address.

If, for any reason, it is not possible to meet the stated delivery date, we will inform the client of this circumstance and offer the option to continue with the purchase while setting a new delivery date.

If the client wishes to receive their order within a shorter timeframe, they must contact us, and we will make every effort to accommodate the request. If, for reasons beyond our control, we are unable to complete the delivery within the indicative maximum timeframe, we will contact the client to agree upon a new delivery date.

In the event that delivery cannot be completed because the client is unavailable at the time of delivery, it shall be the client’s responsibility to coordinate a new delivery directly with the transport company.

COMMUNICATIONS AND NOTIFICATIONS

Applicable regulations require that certain information or communications we send to the Client be in writing. By using this website, the Client agrees that most communications with OONA VENTURES SL may be conducted electronically. For contractual purposes, the Client consents to the use of this electronic communication method and acknowledges that all contracts, notifications, information, and other communications sent electronically by us satisfy the legal requirement to be in writing. This condition does not affect any rights granted to the Client by law.

Notifications sent by the Client should preferably be submitted through the contact form available on our website. In accordance with the above clause, and unless otherwise specified, OONA VENTURES SL may send communications to the Client either by email or to the postal address provided at the time of placing an order.

Notifications will be deemed received and properly delivered at the moment they are posted on our website, 24 hours after an email has been sent, or three days after the mailing date of any letter.

EXCHANGES, RETURNS AND RIGHT OF WITHDRAWAL POLICY

We recommend that the client checks the condition of their order upon receipt to identify any defects or discrepancies and contacts OONA VENTURES SL immediately. The client may also exercise their right to withdraw from the purchase.

  • Returns and/or exchanges due to defects or manufacturing faults: If the client considers, at the time of delivery, that the product is defective or does not conform to the contract, they must contact us providing the product details as well as the nature of the defect or damage. OONA VENTURES SL will then provide instructions on how to proceed. Once the product is returned, we will examine it carefully and notify the Client by email within a reasonable timeframe whether a refund or replacement is appropriate. The refund or replacement will be processed as soon as possible, and in any case within 14 days from confirmation that it is warranted. The Client may either return the product for a refund of the purchase price or request a replacement product of the same type in good condition at no additional cost. Payments made for products returned due to verified defects will be refunded in full, including delivery costs incurred to deliver the item and any return shipping costs borne by the Client. Rights recognised by applicable law remain unaffected.
  • Right of withdrawal: Under current applicable law, the client, as a consumer, has the right to withdraw from the contract without providing any justification within 14 calendar days from the receipt of the product by the client or a third party indicated by them, other than the carrier. In cases where items in the order are delivered separately, the 14-day period starts from the day the client or a third party indicated by them (other than the carrier) acquires physical possession of the last of the goods. To exercise the right of withdrawal, the Client must notify their decision unequivocally via email to info@oonacollections.com or using the contact form available on the website. In the event of withdrawal, we will refund all payments received (the return shipping costs will be at the client's charge and the amount corresponding the complimentary shipping to his address will be deducted from the refund and OONA VENTURES SL reserves the right to deduct bank charges and commissions due to the payment method) without undue delay, and no later than 14 calendar days from the date we are informed of the Client’s decision. The refund will be made using the same payment method used in the original transaction. OONA VENTURES SL may withhold the refund until the goods have been received or until the client provides proof of return. The client is responsible for the cost of returning the goods. The client will also be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. The right of withdrawal applies exclusively to products returned in the same condition as received. No refund will be issued for products that have been used beyond mere opening, are not in their original condition, or have been modified or damaged. Products must be returned including all original packaging, instructions, and any accompanying documentation. The order receipt must also be included. A standard withdrawal form may include the following details:

o   To the attention of (company, address, email):

o   I hereby give notice that I withdraw from my contract of sale of the following good/service:

o   Order received on:

o   Name of consumer:

o   Address of consumer:

o   Signature (only if submitted on paper):

o   Date:

Due to the special nature of certain products, the following exceptions apply:

  • Returns or withdrawal are carried out under the buyer’s responsibility. Items must be returned unused, untested, and unmodified, in optimal condition and in their original packaging. Pieces should be sent in a closed package, in perfect condition and packaged separately (if more than one), without scratching or damage, exactly as received, including a copy of the invoice. The invoice or proof of purchase and any certificate of authenticity must be included.
  • For reasons of health and hygiene, returns, exchanges, or withdrawal are not accepted for sealed products that have been opened, except in cases of manufacturing defects. Earrings cannot be returned for hygiene reasons.
  • Custom-made, personalised, or modified products are excluded from any exchange, return, or withdrawal.
  • Products sold at a promotional or discounted price for a limited time cannot be returned.
  • Shipping and return costs will only be refunded if OONA VENTURES SL sent the wrong product, or in cases of defect or manufacturing fault.
  • For returns from outside the European Union (excluding the United Kingdom), the Client must cover any customs duties/taxes incurred on arrival at the destination country and may be required to pay return shipping and customs duties if applicable.
  • TEMPORARY EXCEPTION: Currently, returns from the United Kingdom cannot be accepted due to specific EU/UK import regulations.

WARRANTIES, LIABILITY AND DISCLAIMER

OONA VENTURES SL provides its clients with the warranty established under Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text of the General Law for the Protection of Consumers and Users. This warranty does not cover damages caused by normal use or improper use of the product.

Unless expressly stated otherwise in these Terms and Conditions, our liability regarding any product purchased through our website is strictly limited to the purchase price of that product.

However, unless otherwise required by law, we do not accept any liability for the following losses, regardless of their origin: loss of income or sales, loss of business, loss of profits, loss of contracts, loss of expected savings, loss of data, and loss of management time or office hours.

Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy or security of information transmitted or obtained via this website, unless expressly stated otherwise.

All descriptions, information, and graphic materials displayed on our website are provided “as is”, without any express or implied warranties, except as legally established. Materials provided by OONA VENTURES SL to describe products on the website aim to be as accurate as possible. However, products may be subject to colour variations or appear larger or smaller than their actual size due to the Client’s screen settings. These characteristics shall not be considered defects or faults.

If the Client purchases as a consumer, OONA VENTURES SL is obliged to deliver items that conform to the contract and is liable for any lack of conformity existing at the time of delivery. Products are deemed to conform to the contract if they match the description provided by us, are suitable for the uses for which products of this type are ordinarily intended, and possess the quality and performance typical of products of this kind.

Handcrafted jewellery products produced and sold by OONA VENTURES SL may naturally exhibit characteristics of the materials used in their manufacture. Such characteristics, including variations in texture, shape, and colour, shall not be considered defects or faults; they are unavoidable and form part of the individual appearance of the product.

FORCE MAJEURE

OONA VENTURES SL shall not be held liable for any failure or delay in the performance of any obligations when such failure or delay is due to events beyond our reasonable control (“Force Majeure Event”). Force Majeure Events include any act, event, default, omission, or accident beyond our reasonable control, including, but not limited to: strikes, lockouts, or other industrial action; civil commotion, riots, invasion, terrorist threat or attack, war (declared or undeclared) or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster; inability to use trains, ships, aircraft, motor vehicles, or other means of public or private transport; inability to use public or private telecommunications systems; acts, decrees, legislation, regulations, or restrictions of any government or public authority.

The obligations of OONA VENTURES SL shall be suspended for the duration of the Force Majeure Event, and we shall be granted an extension of time to perform such obligations equal to the period during which the Force Majeure Event continues. We will use all reasonable endeavours to bring the Force Majeure Event to an end or to find a solution that allows us to fulfil our obligations despite the Force Majeure Event.

PREVENTION OF MONEY LAUNDERING AND TERRORIST FINANCING

As OONA VENTURES SL is engaged in the commercialisation of jewellery items, it is obliged and subject under Law 10/2020 of 28 April to the prevention of money laundering and terrorist financing.

Among other applicable obligations arising from this requirement, we must identify and retain a copy of a valid identity document (DNI, Passport, etc.) from any customer making a purchase of €1,000.00 or more in jewellery products.

Therefore, the customer acknowledges this legal obligation and undertakes to provide, upon our request, a copy of the valid identity document of the payer in order to comply with it. The order will be held at our logistics centre until this requirement is fulfilled and may be cancelled if the requested documentation is not provided.

AMENDMENT OF TERMS

OONA VENTURES SL reserves the right to modify these Terms of Use and Conditions of Purchase at any time.

The customer will be bound by the Terms of Use and Conditions of Purchase in force at the time of using the website or placing each order, except where law or decisions by governmental authorities require us to make changes retroactively to these policies, Terms, or Privacy Statement. In such cases, any changes may also apply to orders previously placed by the customer.

WAIVER

The failure on our part to strictly require the customer to comply with any of the obligations assumed under a contract or these Terms of Use and Conditions of Purchase, or our failure to exercise any rights or actions to which we may be entitled, shall not constitute a waiver or limitation of such rights or actions, nor shall it release the customer from complying with such obligations.

No waiver by us of a specific right or action shall constitute a waiver of any other rights or actions arising from a contract or these Terms of Use and Conditions of Purchase. No waiver by us of any of these Terms of Use and Conditions of Purchase, or of the rights or actions arising from a contract, shall have effect unless it is expressly stated as a waiver and formalised in writing, and communicated to you in accordance with the Notifications section above.

ASSIGNMENT OF RIGHTS AND OBLIGATIONS

The contract is binding on both the customer and OONA VENTURES SL, as well as on our respective successors, assignees, and beneficiaries.

The customer may not transfer, assign, pledge, or otherwise dispose of a contract or any of the rights or obligations arising from it without obtaining our prior written consent. We may transfer, assign, pledge, subcontract, or otherwise dispose of a contract or any of the rights or obligations arising from it at any time during its term. For the avoidance of doubt, such transfers, assignments, pledges, or other dispositions shall not affect the rights that the customer, as a consumer, may be legally entitled to, nor shall they void, reduce, or otherwise limit any warranties, whether express or implied, that we may have granted.

APPLICABLE LAW AND JURISDICTION

The use of the OONA VENTURES SL website and the purchase contracts for products made through it shall be governed by Spanish law, in particular by the regulations governing electronic commerce, specifically the Law on Information Society Services (LSSI-CE).

Any dispute arising from or related to the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals. If you are contracting as a consumer, nothing in this clause shall affect the rights to which you are entitled under applicable law.

Furthermore, in accordance with Regulation (EU) 524/2013, you have access to a European online dispute resolution platform at the following link: https://ec.europa.eu/consumers/odr/.
